These Terms & Conditions ("Terms") govern your access to and use of our website, products, and cybersecurity services (collectively, the "Services"). By accessing our website, purchasing a service, or otherwise using CyberCartNow, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

CyberCartNow serves clients globally. These Terms apply regardless of your location, subject to local law overrides described in Section 16.

1. Who We Are

CyberCartNow is a provider of professional cybersecurity services, including but not limited to penetration testing, source code security scanning, security architecture assessments, and advisory engagements ("Services"). Our registered business details are:

2. Eligibility

By using our Services, you represent that:

  • You are at least 18 years old, or the legal age of majority in your jurisdiction.
  • You have the authority to bind the organization on whose behalf you are purchasing Services, if applicable.
  • The information you provide during account creation, checkout, or engagement scoping is accurate and complete.

3. Nature of Services

CyberCartNow provides professional, project-based cybersecurity services, not physical goods. Each Service listing on our website includes a description of scope, deliverables, and estimated timeline ("Level of Effort"). Specific scope details (e.g., number of applications tested, cloud environments covered) are as stated in the product description at time of purchase, or as agreed in a separate signed Statement of Work ("SOW") for custom engagements.

Where a Service requires a custom scoping call, pricing shown on the website may be indicative and subject to a finalized quote before engagement begins.

4. Account Registration

Certain features (checkout, order history, gated pricing) require creating an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorized use of your account.

5. Orders, Pricing & Currency

All prices are listed primarily in US Dollars (USD). Where displayed in other currencies, amounts are indicative conversions based on rates updated periodically and are not guaranteed at the point of settlement unless explicitly confirmed at checkout.

We reserve the right to correct pricing errors, even after an order has been placed, and will notify you before proceeding if a correction affects your order.

Placing an order constitutes an offer to purchase; a contract is formed only when we confirm acceptance of your order (e.g., via order confirmation email or scoping confirmation).

6. Payment Terms

We accept payment via:

(a) Razorpay — Card, UPI, net banking, and wallet payments processed securely through Razorpay's payment infrastructure. We do not store your full card details; Razorpay's own terms and privacy policy govern the handling of payment credentials during transaction processing.

(b) Manual Bank Transfer — For clients who prefer wire/bank transfer, we provide bank account details at checkout. Orders paid via bank transfer are marked "Pending Verification" until:

  • We receive confirmation of funds in our account, and
  • Our team manually verifies and approves the payment.

Services will not commence until payment is confirmed and verified, except where a separate written payment schedule (e.g., milestone billing) has been agreed for large engagements.

We reserve the right to decline or delay any order pending fraud or compliance checks.

7. Cancellations & Refunds

Because our Services are professional/consulting engagements rather than physical products:

  • Before work commences: Cancellations made before scoping or engagement kickoff are eligible for a full refund, less any payment processing fees already incurred.
  • After work commences: Refunds for partially delivered engagements will be assessed on a pro-rata basis reflecting work completed, at our sole discretion, unless otherwise specified in a signed SOW.
  • Bank transfer orders not yet verified: May be cancelled and refunded in full before verification/engagement start.

Refund requests should be sent to support@cybercartnow.com and will be processed within 10 business days of approval, to the original payment method where possible.

8. Client Responsibilities

For engagements such as penetration testing, source code scanning, or architecture review, you agree to:

  • Provide accurate scoping information (assets, environments, applications in scope).
  • Obtain all necessary internal authorizations before granting us access to test or review your systems.
  • Not hold CyberCartNow liable for issues arising from inaccurate scoping information you provide.
  • Where applicable, sign any required Rules of Engagement or Authorization to Test document prior to active testing.

9. Confidentiality

Both parties agree to keep confidential any non-public information disclosed during the engagement, including findings, vulnerabilities, architecture details, and business information, except:

  • As required by law or regulation,
  • As necessary to deliver the Services,
  • With the disclosing party's prior written consent.

This obligation survives termination of the engagement. For larger engagements, a separate mutual NDA may be executed and will govern in the event of conflict with this section.

10. Intellectual Property

  • Our materials: All website content, methodologies, templates, tooling, and report formats remain the intellectual property of CyberCartNow unless explicitly transferred in writing.
  • Deliverables: Final reports and deliverables produced specifically for your engagement are licensed to you for your internal use (including sharing with auditors, regulators, or customers as needed to demonstrate compliance), but underlying methodology and tooling remain our property.
  • Your materials: You retain all rights to your own systems, code, and data. We claim no ownership over any client-provided materials.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • CyberCartNow's total liability arising out of or related to any Service shall not exceed the total fees paid by you for that specific engagement in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunity, even if advised of the possibility of such damages.
  • Security testing services identify vulnerabilities based on the scope, time, and access agreed at the time of engagement. We do not guarantee that all vulnerabilities will be identified, nor do we guarantee that your systems will be free from compromise following our engagement.
  • Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., liability for gross negligence, willful misconduct, or fraud, where such exclusion is not permitted).

12. Indemnification

You agree to indemnify and hold harmless CyberCartNow, its officers, employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms,
  • Inaccurate scoping or authorization information provided by you,
  • Your misuse of any deliverables or reports we provide.

13. Third-Party Services

Our website and Services may rely on third-party providers, including but not limited to:

  • Razorpay (payment processing)
  • Supabase (application infrastructure and data storage)
  • Currency exchange rate providers

We are not responsible for the acts, omissions, or downtime of third-party providers, though we select vendors with appropriate security and compliance standards.

14. Service Availability

We aim to keep our website available at all times but do not guarantee uninterrupted access. We may suspend or modify the website or Services for maintenance, security, or operational reasons without prior notice where necessary.

15. Termination

We reserve the right to suspend or terminate your account or refuse Service if:

  • You breach these Terms,
  • We reasonably suspect fraudulent, abusive, or illegal activity,
  • Continuing the engagement would expose either party to legal or security risk.

16. Governing Law & International Clients

Since CyberCartNow serves clients globally, the following applies unless a signed SOW states otherwise:

  • These Terms are governed by the laws of the USA, without regard to conflict-of-law principles.
  • If you are located in the EU/UK, EEA consumer protection and GDPR rights (see our Privacy Policy) apply regardless of this governing law clause.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or a notice on our website. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
